Terms & Conditions *

1. Overview These Terms & Conditions (“Terms”) govern the provision of AppleIQ Corporate Services, including device setup, training, repair, software management, insurance reporting, and asset audits (“Services”). By engaging AppleIQ (Pty) Ltd, the Client (“Client”) agrees to these Terms. 2. Scope of Services AppleIQ provides integrated technology management solutions for Apple devices within an organization. Services may include: Device deployment, configuration, and maintenance Staff training and capacity development Software installation, licensing, and compliance Insurance reporting and claims support Device performance auditing and lifecycle management Each engagement will be defined in a Corporate Proposal or Service Agreement, outlining specific deliverables, timelines, and costs. 3. Service Proposals and Acceptance Proposals are valid for 30 days from the date of issue. A proposal is considered accepted once AppleIQ receives written confirmation (email or signed acceptance) from the Client. Services commence only after deposit or full payment (as specified in the proposal) is received. 4. Payment Terms Standard payment terms are 50% deposit upon acceptance and 50% upon completion, unless otherwise agreed in writing. For ongoing contracts or subscriptions, invoices are payable within 30 days of issue. Late payments may incur interest at 2% per month on overdue balances. 5. Corporate Service Plans Clients may subscribe to any of the following plans: Essential Plan (1–10 devices) Professional Plan (11–50 devices) Enterprise Plan (50+ devices) Each plan includes defined service levels and benefits, detailed in the Corporate Proposal or Service Level Agreement (SLA). 6. Client Responsibilities The Client agrees to: Provide access to devices, systems, and premises where services are rendered. Ensure that all data is backed up prior to any service. Cooperate with AppleIQ technicians and provide accurate information. Maintain all necessary software licenses and insurance policies for their devices. AppleIQ shall not be held liable for data loss or third-party software issues arising during service execution. 7. Warranties and Liability All hardware repairs are covered by a 90-day workmanship warranty unless stated otherwise. AppleIQ is not liable for indirect, incidental, or consequential damages including data loss, business interruption, or loss of profit. Warranty does not cover damage caused by misuse, unauthorized repairs, or software corruption. 8. Confidentiality Both parties agree to maintain the confidentiality of business, technical, and personal information shared during the service period. AppleIQ follows strict data protection standards in compliance with the Protection of Personal Information Act (POPIA). 9. Insurance Reporting & Claims When AppleIQ provides insurance reporting services: Reports are prepared based on device inspection and factual assessment. AppleIQ does not guarantee claim approval by insurers. All communication between the Client and the insurer remains the Client’s responsibility. 10. Cancellation & Termination Either party may terminate the agreement with 30 days’ written notice. Cancellation of a scheduled service less than 48 hours before commencement may result in a 20% cancellation fee. AppleIQ may suspend services if payment obligations are not met. 11. Intellectual Property All training materials, documentation, and digital assets provided by AppleIQ remain the intellectual property of AppleIQ and may not be reproduced, resold, or distributed without written consent. 12. Force Majeure AppleIQ shall not be held liable for failure to perform due to circumstances beyond reasonable control, including natural disasters, strikes, system outages, or regulatory restrictions. 13. Governing Law These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa. Any dispute shall be subject to the jurisdiction of the Port Elizabeth Magistrate’s Court. 14.
